Terms and Conditions
YOUR RIGHT TO REGISTER FOR AND USE A COURSE(S) IS GOVERNED BY THE TERMS AND
CONDITIONS SET FORTH IN THIS AGREEMENT, AND COMPLETION OF YOUR REGISTRATION FOR
A COURSE(S) CONSTITUTES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS OF THIS
AGREEMENT. IF YOU DO NOT ACCEPT THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU
MAY NOT REGISTER FOR SUCH COURSE(S).
1. GRANT OF LICENSE. Upon your payment of the applicable
licensing fee, Bisk, as Licensor, grants to you, the LICENSEE, a non-exclusive,
non-transferable, limited license to access, view and use online the Course(s)
you select for a period of one (1) year (in accordance with NASBA
requirements). If you purchase a subscription to CPEASY ONDEMAND
(“Subscription”), your Subscription shall be good for one (1) year, commencing
on the date payment is received (Subscription access will be granted the same
day as confirmed payment). Upon purchase of any product, you will be assigned a
unique, non-transferable user Identification and password. In the case of
business or corporate purchases on behalf of employee(s): for individual course
or block purchases, this Agreement and the license for each Course shall extend
to the employee(s) who access the Course; for Subscription(s), a
non-transferable Subscription license shall be assigned to, and this Agreement
shall apply to, the individual named employee(s) subscribed.
2. COPYING. You may download and/or print, for your personal
use only, no more than one (1) copy of any Course(s) for which you are
registering and paying the applicable fee. You may not make any additional
copies of the Course(s), in whole or in part, in any format (i.e., print or
electronic form), or transfer, loan, lease, or otherwise distribute in any
manner any part of the Course(s) to a third party. You may not modify or create
derivative works from the Course(s) or related materials. Bisk reserves all
rights not expressly granted to LICENSEE.
3. OWNERSHIP. Except for the limited license expressly granted
to you under this Agreement, Bisk Education and its licensors retain all right,
title and interest in and to the Course(s), including any authorized copies and
all related materials. It shall be a violation of this Agreement if you remove
any copyright or other proprietary rights notices from the Course(s). This
License is not a sale of any original Course content or any copy.
4. REPRESENTATIONS OF LICENSEE. By entering into this
Agreement, you represent and warrant that (a) all information you supply during
the registration process for each Course and/or Subscription is true, accurate,
current and complete; (b) you will not register under the name of, nor attempt
to enter or use in any way, a Course and/or Subscription granted to another
person, business or corporation; (c) if the Subscriber is a business or
corporation, the person entering into this Agreement is authorized to do so;
(d) you will not disclose your User Identification or Password to any third
parties and will notify Bisk Education at info@CPEasy.com of any known or
suspected unauthorized use of your User Identification, Password or rights
granted under this Agreement; and (e) you will be responsible for any and all
use of your Course and/or Subscription and any and all access to and use of the
Courses, whether or not such access and use is authorized by you, and you will
indemnify and hold Bisk Education harmless with respect to any such authorized
or unauthorized access and use.
5. RESERVATION OF RIGHTS. Bisk reserves the right, in its sole
discretion, from time to time during the term of this Agreement to: (a) add to
or delete from the Courses offered; (b) discontinue any particular Course or
Courses; (c) amend this Agreement by posting such amended Agreement on the Bisk
Website, and (d) disclose Continuing Professional Education information to the
appropriate reporting agencies. You may either expressly acknowledge and agree
to be bound by the terms of such amended Agreement or simply use your
Subscription to register for a Course after the posting of such amended
Agreement on the Bisk Education Web site and thereby agree to be bound by the
terms of such amended Agreement. If you do not agree to be bound by the terms
of such amended Agreement, you may terminate this Agreement as set forth below.
6. REFUND POLICY. Should you not be completely satisfied with
any product for any reason, you have thirty (30) days from purchase to request
a full refund. It is assumed that, after thirty (30) days, you are satisfied
with the materials and services provided by Bisk. If, during the first thirty
(30) days after purchase, you take a Course(s) for credit and then request a
refund, the refund will not include the full retail value of the Course(s)
completed. All refund requests must be made by phone. A Return Authorization
number will be assigned by Bisk during your call. This Return Authorization
Number is required to receive a refund. If you have received materials that
need to be returned, you will also be sent a mail return label. Books and
Materials must be returned postage pre-paid. All books and materials must be
received within thirty (30) days of the date of a valid refund request, or you
will be charged the retail rate for the books and materials. To facilitate the
processing of your return, include a copy of your original invoice, or invoice
number and the “Return Authorization Number” in the box of returned goods. All
materials and books are shipped in packaging which is only good for one
mailing. We advise that the return shipment be packaged in new packaging and
insured, as we cannot be responsible for books and materials that do not arrive
at our facility in the appropriate condition. Unreturned books and materials
fees will be deducted from any refund amount you are owed. Once we have
received the returned product, we will issue the appropriate product refund. To
qualify to receive a refund, books and materials must be returned in their
original condition with any shrink wrap intact. Books and materials that have
been written in or otherwise defaced cannot be returned and will not be
accepted. You are responsible for any related collection costs and/or legal
fees. These terms are governed by Florida law, with venue and jurisdiction for
any proceeding arising out of or in connection with these terms in Hillsborough

7. USE RESTRICTIONS. You may use the Course(s) to produce a
document, a publication or presentation material that is for you, for an
employer or for a single client. Without Bisk’s prior express written
authorization, you may NOT use the Course(s) or its contents, in whole or in
part, to produce any form of stock documents, publication or presentation
material, or to produce any document, publication or presentation materials for
more than one (1) client, or for transfer, use, multiple resale or
redistribution.
8. UPDATE POLICY. Bisk may create, from time to time, updated
versions of the Course(s). At its option, Bisk will make such updates available
to the LICENSEE.
9. PUBLISHER DISCLAIMER OF WARRANTY. BISK MAKES NO WARRANTIES,
EXPRESS OR IMPLIED, WITH RESPECT TO THE COURSE(S) OR ITS QUALITY, PERFORMANCE,
MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. THE COURSE(S) IS
LICENSED AND DELIVERED “AS IS.”
10. LIMITATION OF LIABILITY. IN NO EVENT WILL BISK OR ITS
DEVELOPERS, OFFICERS, EMPLOYEES OR AFFILIATES BE LIABLE TO YOU FOR ANY
CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES (INCLUDING DAMAGES FOR LOSS OF
BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION AND THE
LIKE), WHETHER FORESEEABLE OR UNFORESEEABLE, ARISING OUT OF THE USE OR
INABILITY TO USE THE COURSE(S) OR ACCOMPANYING WRITTEN MATERIALS, REGARDLESS OF
THE BASIS OF THE CLAIM AND EVEN IF BISK OR AN AUTHORIZED BISK REPRESENTATIVE
HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BISK’S ENTIRE LIABILITY
AND YOUR EXCLUSIVE REMEDY SHALL BE A RETURN OF THE PURCHASE PRICE.
Bisk shall have no liability for any text or data stored in or used with this
Bisk product, including the cost of recovering or reproducing this text or
data. All Courses are to be used as an educational tool only. Course(s) and
support given by Bisk’s technical support staff are in no way substitutes for
assistance from legal, tax and accounting professionals.
THE ABOVE ARE THE ONLY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED,
INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE, THAT ARE MADE BY BISK. NO ORAL OR WRITTEN
INFORMATION OR ADVICE GIVEN BY BISK, ITS DEALERS, DISTRIBUTORS, AGENTS OR
EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS
WARRANTY, AND YOU MAY NOT RELY ON ANY SUCH INFORMATION OR ADVICE.
11. JURISDICTION AND VENUE. This Agreement and this Disclaimer
of Warranty and Limited Warranty is governed by the laws of the State of
Florida. You agree that Hillsborough County, Florida, shall be the legal venue
in any action arising under or as a result of this Agreement.
12. U.S. GOVERNMENT RESTRICTED RIGHTS. Course(s) and
documentation are provided with RESTRICTED RIGHTS. Use, duplication or
disclosure by the Government is subject to restrictions as set forth in
subdivision (b)(3)(ii) of The Right in Technical Data and Computer Software
clause at 252.227-7013.

the Office of Professional Responsibility, Internal Revenue Service, to meet
the requirements of 31 Code of Federal Regulations, section 10.6(g), covering
maintenance of attendance records, retention of program outlines,
qualifications of instructors, and length of class hours. This agreement does
not constitute an endorsement by the Office of Professional Responsibility as
to the quality of the program or its contribution to the professional
competence of the enrolled individual.
